DESCENDANTS OF MURTOUGH MCDOWELL
INTRODUCTION
The genealogy of Murtough McDowell and his son Michael is important to McDowell genealogists for the simple reason that their descendants pop up in Virginia, North Carolina, Kentucky, and Tennessee both before and after the Revolutionary War in a manner that can get them conflated with other McDowell family lines. However, the Y-chromosome DNA of modern-day males clearly distinguishes this family grouping from others, assuming that the genealogy has been correctly done.
One genealogist in particular has done an outstanding job of capturing the story of Murtough McDowell and his descendants. A Google search of his name or hyperlinking to
DNAeXplained will give the reader access to the data. We have used the information at this site to reconstruct Murtough's genealogy and have added additional data.

Murtough McDowell, an immigrant, was living in Baltimore County MD in 1722. His wife was named Eleanor/Elinor. Two sons have been identified.

His son Michael sold Murtough's land in 1752 as a resident of Halifax County VA. We first display a transcription of a Power of Attorney executed by Michael on 19 September 1752.

The deed from Michel McDowell to Joseph Murray Junior was recorded on the same day of 19 September 1752.
This Indenture made the Nineteenth Day of September in the year of our Lord one Thousand seven hundred and fifty two between Michel Macdowel of Halifax County in the Colony of Virginia plantor of the one part, and Josephus Murray Junr of the County of Baltimore and Province of Maryland of the other part. A receipt for 10 pounds dated 5 March 1753 exists.

Michael McDowell/Mackdonall is reported at PMT as being born before 1732 in Baltimore County, Maryland with parents Morto McDowell/Mackdonall [c1700 - c1767 Kent County MD] and Eleanor/Elinor along with a brother John McDowell/Mackdonall born 28 May 1724 in Baltimore County, Maryland. We have not verified this information. The source also claims that Michael was in Halifax County, Virginia in 1755. Roberta Estes reports him as born 1720 in Ireland with death date after 1755 in Bedford County VA. We have found a reference to a McDowell in Bedford County in 1762. He is believed to have had at least one son named Michael and possibly a second one named Mathew.
As described in his father's section, Michael resided in Halifax County VA in 1752 at the time he sold his interest in a tract of land in Baltimore County, Maryland. A Michael McDowell appears in Halifax County Court Orders Book 1 in the year 1753 as a plaintiff.

A land entry index reports that a Michael McDouell filed for land in Pittsylvania County VA, a county formed in 1767 from Halifax County, but we have been unable to find the original land entry book to ascertain the details.[

Michael McDowell [1747 - 6 July 1840] married Isabel Hall [1753 - c1845], but the details are unknown.[
McDowell, 462] The death date of Michael was recorded at the county court and his son
William became the administrator of his estate.
Satisfactory evidence was produced in open court to prove that Micheal McDowell a pensioner departed this life on the 6th day of July 1840 and thereupon came Wm McDowell and took upon himself the administration of sd estate who gave bond and security that was accepted by the court and after taking the oath required by law.

Michael was likely born in Halifix County VA where his father resided in 1752 before the move to Bedford County VA where his father resided in 1753. As shown by the following tax listings and by his Revolutionary War record to be discussed below, we know that Michael was in Bedford County by the time of the Revolutionary War.

Sometime before 1809, Michael left Wilkes County and appeared in the Lee County VA tax lists with a mixture of his putative sons. We note that his property in Claiborne County TN is near the border of Lee County VA and it's likely that he actually was living in Claiborne County until the border between the two states was fully set in place, likely by 1814.

In early 1810, Michael McDowell informed the court that his sons
Edward and
Luke McDowell were guilty of gaming or playing cards on the Sabbath, New Year's Day. Subsequently, on 26 February, James Miles beat up Michael. In April, the Grand Jury of Lee County VA filed "presentments" against his sons and James Miles. The sheriff was unable to find either son to present a summons to appear in court. We note that
Edward and
Luke no longer appear on the Lee County tax listings after 1810. This event could explain why
Edward went to Pulaski County KY and
Luke went to De Kalb County TN.
We of the Grand jury present David Fee, George Travis, Edward McDowel, Luke McDowell and James Nottinghand for unlawful gaming by playing at Cards in the tavern of Joseph Kogen at a game called Loo on the first day of January last past on the information of William Lumpten, Michael McDowell and Thomas Warren farmers in Lee sworn in Court and sent to us.
We of the Grand jury present Joseph Kogen innkeeper in the town of Jonesville for keeping a disorderly house by suffering a number of idel and dessolute persons to drink riot and qurrel on the sabbath within six months last past and by suffering David Fee, Edward McDowell and others to game unlawfully in his house by playing at cards at a game called Loo on the 1st day of February last past on the information of Thomas Warren and Michael McDowell farmers in Lee sworn in Court & sent to us.

The land records of Michael in Claiborn County begin with two land grants with entry dates of 14 January 1814, one for 15 acres and one for 25 acres.[

Know Ye, That in consideration of an entry made in the Surveyor's Office of the fifth District, of No. 1027, dated the 14h day of January 1814, founded on a certificate of No. 851, issued by the Register of West Tennessee to John Beahan for two hundred acres of land elected the 17h day of January 1812 fifteen acres of which are assigned to Michael McDowell the enterer there is granted by the said State of Tennessee unto the said Michael McDowell and his heirs a certain tract or parcel of land containing fifteen acres lying in the County of Claiborn in said district on Powells river and by 4 mile creek and its bluff adjoining Herralls line begining on the north bank of Powells river above the mouth of 4 mile creek thence up the river as it meanders seventy poles to a sugar tree thence north eleven west sixty poles to a stake then south fifty six west thirty two poles to a post oak thence south twelve west forty poles to a beech cutter east bank of 4 mile creek thence down the creek with its meanders forty four poles to an elm thence north sixty five east six poles to the beginning.
Know Ye, That in consideration of an entry made in the Surveyor's Office of the fifth District, of No. 1026, dated the 14th day of January 1814, founded on a certificate of No. 1395, issued by the Register of East Tennessee to John Brown for one hundred acres of land elected the 6th day of February 1813 twenty five acres of which are assigned to Michael McDowell the enterer there is granted by the said State of Tennessee unto the said Michael McDowell and his heirs a certain tract or parcel of land containing twenty five acres lying in the County of Claiborn in said district on the south side of Powells river opposite the mouth of 4 mile creek between the lines of S. Fortner and the river between improvement begining at a large elm on the bank of the river thence down the river as it meanders twenty poles to a stake north sixty poles to a dogwood in Fortners line thence with his several lines north seventy two west thirty poles to a bush north twenty two west sixty two poles to a stake north sixty nine west twenty four poles to a sugar tree in the bank of the river thence down the river as it meanders to the beginning.
A survey report of 50 acres for Michael has been found dated 23 May 1832. The metes and bounds match closely with the two land entries given above.[

Michael McDowell filed for a pension based on the 1832 Act of Congress. It clearly states that he lived in Bedford County VA during the Revolutionary War.[

MICHAEL McDOWELL S1690 VIRGINIA SERVICE
This day personally appeared before Samuel Powell, Judge of the Circuit Court of Law and this Equity in Claiborne Co., Tennessee, Michael McDowell, age 85, in order to obtain benefit of an Act of Congress, passed June 7, 1832. He made this application 1832. States he entered the service in Bedford County Virginia 1777 or 1778. He was drafted to perform 3 months tour of duty and he belonged to company of Capt. Arther which was attached to the regiment of Col. James Calloway. We then marched to the lead mines in the western part of Virginia and built a fort, and also under Capt. Wm. Leftridge at the same fort. And after his term expired, returned home to his residence in Bedford Co. Va, and again volunteered under Capt. Arther, and marched against the Indians, and again after returning home joined with some neighbors and friends with the citizens of the country calling themselves spies, to protect women and children from the skelping knife of the savage. He went to see his Capt. Arther who now lives in Kentucky and he is so parallized and so palsied so that he cannot speak, so as to be understood.
John Hunt a citizen of Claiborne County Tenn, certify that I am well acquainted with Michael McDowell, and it is reputed and believed in the neighbourhood where he lives that he was a Revolutionary War soldier.
Affidavit of James Gilbert, one of the clergyman of the Baptist Church, state I am well acquainted with Michael McDowell.
John Hunt, High Sheriff of said county makes the same statement.
One source incorrectly claims that the person filing for the pension should be a McDonald.[

McDowell, Michael; 1832 list age 87; served in Va Line; drew pension in Claiborne Co; the name is McDowell on printed list but it is said that it should be Michael McDonald.
Michael filed an affidavit for the Revoluntionary War pension request of Thomas Nun, age 81.[

Affidavit of McDowell, age 86 in 1833, Claiborne Co., Tenn. states he is well acquainted with Thomas Nun, and believes his statements are true.
Michael McDowell appeared in a Claiborne County Pensioner List as a Private, Age 87, born 1744, Enrollment date 4 Mar 1831 in Claiborne, Tennessee; Virginia line.[

On 20 June 1840 in a Claiborne County deed, Michael &
William McDowell sell 2 acres to Anson C. Martin. This deed occurred about a month before the death of Michael.

Sarah "Sally" McDowell [14 September 1816 - 1 January 1886] married Archibald Haynes [7 January 1811 - 28 January 1881] on 5 January 1835 in Pulaski County KY with consent of father Edward McDowell and witnessed by Stephen Hail and
Michael McDowell. In the 1880 Census, she claims both her father and mother were born in Virginia.

Thomas Davis Plaintiff against Edwd McDowell & John Hall Defendants } In Trespass Assault and Battery. This day came the plaintiff by his attorney and thereupon came a jury to wit [List] who being elected tried and sworn well and truly to enquire of damages against the Defendant Hall in the suit, upon their oath do say that the plaintiff hath sustained damages by the occasion in the declaration mentioned to ten dollars besides his cost. Therefore, it is considered by the Court that the plaintiff recover against the said Defendant John Hall and John Woodson security for his appearance his damages aforesaid in form aforesaid assessed and his costs by him in this behalf expended.

Edward first appeared in the tax listings of Lee County VA in 1809 and 1810 as presented in his father's
Tax Table. His move from Lee County to Pulaski County was almost certainly driven by a court case in which his father turned him in for playing cards on a Sunday. That story is told in his
father's section. He appeared in the following tax records of Pulaski County KY starting in 1811 which were accessed from 1799 to 1858. There are many tracts of land and their acreage seems to change from year to year with new tracts appearing and disappearing but few deeds to explain the changes.

On the motion of John Owens to have Commissioners appointed to convey land &C (which was continued till this day on yesterday) is now taken up, therefore in pursuance of an act of General Assembly Kentucky approved March 1st 1797 "for the conveyance and division of land" the said John Owens exhibited to this Court a Bond executed to him sd Owens by Thomas Smith in his lifetime which was proved to be the act and deed of the said Thomas Smith by the oath of Tunstall Quarles a subscribing witness thereto, and the same was ordered to be recorded. Which said Bond from its references, it appears that one hundred acres of land was to be conveyed to said Owens for which one hundred acres of land the sd Owens proved by William [Owens] senr that the consideration for said land was paid. And on the motion of sd John Owens assee of Reuben Short who was assee of William Jones to have Commissioners appointed as aforesaid also exhibted to the Court a Bond transferred to him as aforesaid executed by the sd Thomas Smith and John Owens as his security in his said Smith's lifetime to the above named William Jones for the Conveyance of fifty acres of land which was proved to be the act and deed of the aforesd Smith & proven by the oath of Gideon Prather, a subscribing witness thereto, which is also ordered to be recorded and it appears from the testimony of Edward McDowell (who was introduced & sworn) that the consideration for said fifty acres of land was paid to said Smith & he having failed to make the Conveyance agreeably to his Bond aforesd.
It is therefore ordered that Joseph Porter, John Chesney & John B. McCormick Esqrs be appointed Commissioners to convey the lands in said Bonds mentioned to John Owens agreeably to the Tenor of said Bonds.

An instrument of writing purporting to be the last Will and testament of Edward McDowell dec'd was produced and proven in open court to be the act and deed of the said Edward McDowell dec'd by the oath of John M. I,
Edward McDowell of the County of Pulaski and State of Kentucky, do make, ordain, and publish the following as my last will and testament hereby revoking and annulling all other wills by me heretofore made.
First. I will and devise to my son,
Michael McDowell, during his life, the home place, being the same I now live on, in the County of Pulaski containing one hundred acres, with its appertenances; and at his death the same to be divided among the heirs of his body, if any; if none, then the said tract of land and appertanances to be equally divided among his living brothers and sisters and the heirs of those that may be dead, s'd heirs representing only their father or mothers' part.
Second. I give and devise to my daughter
Eliza McDowell, during her life, my upper place, known as the still-house place and the adjoining survey, 75 acres; and at her death the same to be divided among the heirs of her body, if any; if none, then the said tracts of land to be equally divided among her living brothers and sisters, and the heirs of those that may be dead, said heirs representing only their fathers or mothers' part.
Third. I give and devise to my son,
Franklin McDowell, during his life, fifty six and one half acres of land, at the mouth of Bear Creek, patented in the name of James Campball; and at his death the same to be divided equally among the heirs of his body, if any; if none, then the said tract of land to be equally divided among his living brothers & sisters, and the heirs of those that may be dead, said heirs representing only their fathers or mothers' part.
Fourth. I give and devise to
Maria Roberts, wife of Moses Roberts, during her life, one hundred acres of land, called the Lawrence place; and at her death to be equally divided among the heirs of her body, if any; if none, then the said tract of land to be equally divided among her living brothers and sisters, and the heirs of those that may be dead, said heirs representing only their fathers or mothers' part.
Fifth. I give and devise to my son,
Thomas McDowell, and my daughter,
Sally Haynes, during their several lives, a tract of land lying on Cumberland River, nearly opposite the mouth of Buck Creek, known as the Bundy place, and adjoining thereto, containing one hundred and fifty acres, said land to be equally divided between them; and at the death of the said
Thomas McDowell, the part to which he shall become entitled during life shall pass and descend to the heirs of his body, if any; if none, then to his living brothers and sisters, and the heirs of those that may be dead, said heirs representing only their fathers and mothers' part and in like manner at the death of the said
Sally Haynes, her part or interest in said tract of land, shall pass and decend to the heirs of her body, if any; if none, to pass to her living brothers and sisters and the heirs of those that may be dead, said heirs representing only their fathers and mothers' part.
Sixth. I give and devise to my three grandchildren, heirs of my son,
Martin B. McDowell, dec'd, fifty acres of land lying on the waters of Buck Creek, called the Barnes survey.
Seventh. I give and devise to
Franklin McDowell and
Michael, my sons, all my household and kitchen furniture, all my horses, cattle, hogs and other stock of what description soever remaining at my death, to be equally divided between them.
Eighth. The lands owned by me on Rockcastle River, I wish to sell myself to pay all my debts and funeral expenses; and if sold by myself, I shall hand to my son,
Montgomery McDowell, one of the notes taken by me for said land to the amount of one hundred dollars; if not sold by me, it is my will and desire that my executor, or administrator with the will annexed, shall sell and convey the same; and that he pay out of the proceeds of the sale (if not before paid by me) to
Montgomery McDowell, one hundred dollars and whatever remains after paying all just debts and expenses shall be divided equally among all my heirs.
Ninth. To avoid loss and inconveniences, the Chancellor of the Pulaski Circuit Court with the consent of my executor, or administrator with the will annnexed, is hereby invested with power to hear the petition of any of the above named children for a sale of the lands separately devised to them for life, and after their death to the heirs of their body, if any; and if such petitioner has heirs of his or her body, and it shall appear to the satisfaction of said Chancellor that a sale of said land so asked for shall be advantageous to said child of mine and his or her heirs, a decree may be rendered for said sale, providing for the safe keeping or profitable reinvestment of that part of said sale as the heirs of the petitioner may be entitled to.
Tenth. I hereby invest my executor, or administrator with the will annexed with power to execute deeds for all land sold by him, and all other deeds which I would be bound to make if living and said deeds shall pass title as if made by me.
Lastly. I do nominate and appoint A. R. McKee, executor of this my last will and testament.

Therefore on motion of the plaintiff by his attorney, it is considered and ordered by the Court that the Plaintiffs recover against the said defendant the sum of seventy nine dollars the debt in the writing obligatory in the petition herein mentioned. with Interest thereon after the rate of six per centum per annum from the 3rd day of June 1842 until paid. At the 1816 July Term of the Wilkes County Court, an M. McDowell served as a commissioner to review the 1815 report of Eli Petty, County Trustee.[

Tax Table. His move from Lee County to Pulaski County KY and then to Tennessee was almost certainly driven by a court case in which his father turned him in for playing cards on a Sunday. That story is told in his

Know you that for and in consideration of the sum of one cent per acre paid into the Office of the Entry Taker of Warren County and entered on the 13 day of February 1826 pursuant to the provisions of an act of the General Assembly of said State passed on the third day of December 1825 by No. 1630 there is Granted by the said State of Tennessee unto Luke McDowell a certain tract or parcel of land (with its appurtenances) containing fifty acres by survey bearing date the 20 day of January 1830 lying in said County on the head waters of Holmes Creek. Beginning on a Poplar, running South one hundred and twenty five poles to a stake, Thence West sixty four poles to a stake, thence north one hundred and twenty five poles to a Chesnet and stake, thence east sixty four poles to the beginning. With the hereditaments and appurtenances to have and to hold the said tract or parcel of land with its appurtenances to the said Luke McDowell and his heirs forever. In witness whereof William Carroll Governor of the State of Tennessee has hereunto set his hand and caused the Great Seal of the State to be affixed at Nashville on the 14 day of February 1832 and 56 year of our Independence.

Luke's first identified land transaction via a deed was filed in a DeKalb County deed book dated 27 December 1829 but he was listed as a resident of Warren County at the time in agreement with the 1830 Census above.

Beginning on a bluff southwest of the spring about 50 poles near the house that Brethen Hensly lived in running then North and West for complement so as to include the house and plantation of these acres of warrented land. Mathew McDowell [Bf 1765 - Aft 1810] appears in only the 1810 Census of Pulaski County KY as well as a matching tax list of 1809. However, a number of children are reported on the census record and the ages of some of the males appear to match up with McDowells in Pulaski County and those who move to Tennessee, but who do not match up with the data for
Michael McDowell. Because of the circumstantial connections between Michael and Mathew, we have tentatively assigned them as brothers although no direct evidence exists. We have assigned the following male children to Mathew.

John's son Nathan was a Private in Company D, 2 Regiment (Lillard's) East Tennessee Volunteers of the First Tennessee Cavalry and became a
POW with imprisonment date of 9 September 1863 at Cumberland Gap. He was received at the Louisville Prison on 2 October 1863, discharged from there on 9 Oct 1853, and moved to Camp Morton in Indianapolis on 9 Oct 1863. He was admitted to the prison hospital on 2 Nov 1863 and died at Camp Morton on 1 December 1863 with the cause of death being Chronic Diarrhea. He is buried in grave No. 548 at Green Lawn Cemetery.
Interesting Story
A Rev. Mr. McDowell of Claiborne County TN married Amanda Lee to a Michael Sowder. She later filed an affadavit with the Putnam County Court of Indiana as presented in the following two documents found in Probate Case Files of that county. We have not identifed who this McDowell is. The name Sowder appears as Sowders in the following records, but we have shortened it to Sowder since that version is the more prominent one in other records.
State of Tennessee, Claibourn County } Personally appeared before me the undersigned authority Sally Jones, Elijah Jones and Thos L. Davis citizens of the State and County aforesaid to me well known as credable who being duly sworn according to law, declare that they were personally well acquainted with Michael Sowder during his lifetime, also with his wife Amanda Sowder now Amanda Jones. That said Michael Sowder was married to the aforesaid Amanda Sowder, then "Amanda Lee" in Claiborn County Tenn by one Rev. Mr. McDowell a minister of the Gospel on or about the [blank] day of December 1843. That they the said Michael and Amanda Sowder lived together for some years thereafter as husband and wife and were reputed and respected as such by their neighbors and friends and the affiants never heard of the legality of their said marriage being questioned by any person or persons. Affiants are informed that said Michael Sowder removed to the State of Indiana where he has since died. That after his removal as aforesaid his wife "Amanda" aforesaid was divorced from him and that she remarried to one Samuel Jones on the 25th day of September 1842. Affiants are also personally well acquainted with Mary J. Goin, wife of William Goin and know her to be the daughter of Michael and his wife Amanda Sowder and that she is the only living issue resulting from said marriage.
State of Tennessee, Claiborne County } Personally appeared before me the undersigned authority Amanda Jones a resident of the County and State aforesaid to me well known as a credable person who being duly sworn according to law declares that she was the wife of Michael Sowder Decd late a citizen of the County of Claiborne State of Tennessee but more recently of the State of Indiana. That she was married to the said Michael Sowder in the 3rd Civil District of Claiborne County Tenn on the [blank] day of Decbr 1843 by one Rev. Mr. McDowell a minister of the Gospel. That when said marriage service was performed and there were no witnesses present of the same except Daniel Sowder & his wife now residents of Indiana, there being much opposition to their marriage, and they found the minister aforesaid who married them as aforesaid without the presence of witnesses, said Michael Sowder having a legal license from the Clerk of the County Court of said County authorizing any Justice of the Peace, Judge, or minister of the Gospel to perform the ceremony. He the said McDowell did perforem it without question and the said Michael Sowder gave him the said license from the Clerk aforesaid authorizing him as aforesaid to perform said rites of matrimony. She is informed and believes that said McDowell failed to make return of said license as the law directs and she respectfully refers to the Certificate of the Clerk of said Court as coroberation of her said statement. That the said McDowell has since died and there being no other person present at said marriage as aforesaid, she is unable to show the factly witnesses present. That her maiden name was Amanda Lee, and that there were born to said Michael Sowder and affiant one child a daughter, namely, Mary Jane, who is now the wife of one William Goin and is living in Claiborne County aforesaid, said daughter "Mary Jane" was born on the 14th day of November 1845 and was the only child of affiant and her said husband. Said Michael Sowder removed from the State of Tennessee about the year 1846, and as affiant is informed, he some time thereafter removed to the State of Indiana where he has since died. Affiant having been divorced from the said Michael Sowder was remarried to Samuel Jones whose name she now bears. That the date of said remarriage was 16 [26?] day of Sept 1852 and that she makes this statement with a view of showing that the said Mary J. Goin is the legitimate child and heir at law of said Michael Sowder Decd.

CASE 1
Edward McDowell Pltff against William Jones Deft } In Case. This day the opinion of the Court of Appeals herein affirming the Judgment of the Pulaski Circuity Court was produced and ordered to be entered of record which said opinion reads in these words & figures following (to wit) Kentucky Set Court of Appeals Oct 7th 1815
William Jones Appellant against Edward McDowell Appellee } Upon an appeal from a Judgment of the Pulaski Circuit Court.
The Court being now sufficiently advised of & concerning the premises & having inspected the record & proceedings delivered the following opinion (to wit) This was an action for slandering words brought by the appellee against the appellant in the court below, the Declaration contains two counts, the first charges the appellant of having said that he saw the appellee take corn from Aaron Raineys crib twice and look round to see if any person saw him meaning &C, the second count charges the appellant of having said that he saw the appellant steal Aaron Raineys corn &C, to the first court the appellant filed a Demurer, and to the second count pleaded general issue and a special plea of justification, the appellee filed a joinder to the Demurer, replied to the special plea, and joined issue to the general issue. The law arising on the Demurer was adjudged in favour of the appellee and a writ of enquiry awarded to assess the Damages on the first count and issues having been made up on both the pleas to the second count & Jury was called as well to enquire of Damages on the first court as to try the issues to the second. The jury returned as to try the issues to the second. The jury returned a verdict for the appellant upon the issues and assessed Damages in favour of the appellee upon the writ of enquiry & Judgment was entered in favour of the appellee for the Damages assessed on the first count from this Judgment the appellant has appealed to this Court. The first question made by the assignment of errors is are the words laid in the first count actionable, whether they are actionable or not turns exclusively upon the construction which may be given to them. If they imply a felony in taking of the corn, then as they tend to subject the appellee to criminal punishment, they are most clearly actionable, but if they impart nothing but a bare Trespass, the appellee cannot be said to have been put in danger of legal punishment and no action can be maintained for the speaking of them according to the old rule of construing words in Meliori sensue the latter meaning would provail for the words laid may be true and nothing but a Trespass have been committed, but that rule of construction as justly observed in the case of Logans vs Steele Bibb Rep 594 has long since been exploded and has given way to one which accords more with reason and the common sense of mankind that of construing words in that sense in which they would be understood by those who hear or read them, if the words laid in the first count are tested by this rule and taken by their usual acceptation, they obviously impart a charge of Felony that the words mean something more than a naked trespass is evident for if that had been the only meaning intended to be conveyed, the simple charge of taking the corn would have effected the object, but when the charge of taking is connected with expressions of the manner, the appellee acted in the taking it shews clearly the speaker of the words intended to communicate the idea and that the hearers must so have understood them, that the corn was taken with a felonious intent. It is assigned for error that the Court below erred in entering Judgment in favour of the appellee on the first Count after the jury had found a verdict for the Deft on the second count we can perceive no irregularity in this respect the appellee had a right to lay as many counts in his Declaration as he thought fit and a failure on one Count cannot prevent his recovery on the other. It is also assigned for error that the Court erred in awarding a writ of enquiry to assess Damages on the first count upon overruling the appellants Demurer without first giving him leave to withdraw his Demurer and plead upon a decision of the Court on the Demurer being known to the appellant, he might have applied to the Court for permission to withdraw his Demurer & plead and upon making out a proper case the Court in the due exercise of their discretion should have given him leave to do so but it certainly was not necessary for the Court ex officio to after the appellant permissions to withdraw his Demurer and as the appellant does not appear to have even asked for permission to withdraw his Demurer or pleads the Court properly awarded a writ of enquiry to assess the Damages. Therefore it is considered by the Court that the Judgment of the Circuit Court aforesaid be affirmed that the appellee recover of the appellant ten pr centum Damages on the amount thereof which is ordered to be certified to said Court.

Edward McDowell Pltff against John Prather Deft } In Case. This day came the Plaintiff by his Attorney and tendered to the Court his Bill of Exceptions, which being signed and sealed by the Court, was ordered to be recorded and the same following in these words (Viz)
Be it remembered that upon the trial of this cause the Plaintiff introduced Stephen Hail as a witness who being sworn deposed that a few years past he met with the Defendant Prather, who asked him how the old mill was coming on to which the witness answered that McDowell the Pltff has been talking about repairing it, that Prather then replied, tell him to go on, and repair, and if the mill fell to him upon a final decision, he the Deft would pay him for it, and he had no doubt if it fell to Fisher he would do it, that he saw McDowell very shortly after and told him, what the Deft had said; and shortly thenafter McDowell collected hands & repaired the dam; that being called upon by the Plaintiff to value the work with others he valued it to $50 but upon having the number of hands mentioned as being only 20 in number for two days and the manner of their collection and laboring he had concluded the repairs was not worth more that $10. Being cross examined he said Plaintiff had used the mill for two or three years and it was worth perhaps $100 but he knew not how he held the mill; and he stated also that the Plff had performed no labour on or about the mill until after he delivered the message from the Deft before mentioned. He stated further that he understood a suit between the Deft & Benjamin Fisher was then pending respecting the right to the said mill. The Plaintiff then introduced George Humphreys who being sworn, stated that he examined the work with some others and that he was of opinion that taking into consideration the labour of collecting in the hands; the haling [Sic: hauling] of timber furnishing the hands &C the work was worth $50. He stated that McDowell lived at the mill & made some profit by it, but knew of no contract with the Deft by which he held it. William McDowell being sworn stated that he heard McDowell the Plff request Benjamin Fisher to pay who refused. Shadarick Price being sworn stated that he went with others to examine the work at the request of McDowell and to fix its value; that Capt. Humphreys expressed his opinion that it was worth $50 but he did not think himself a Judge & did not express his opinion nor could he say what it was worth; he thought the Plff entitled because he had procured the hands. The Plaintiff then introduced Charles Cunningham who stated on Oath that he had heard both the Deft & Benjamin Fisher say they had compromised their suit about the mill. And by the agreement of the parties an agreement between the Defendant & Benjamin Fisher was real as evidence following in these words, viz:
Articles of agreement made and executed this 4th day of April 1823 between John Prather of the County of Pulaski and State of Kentucky of the one part and Benjamin Fisher of the County of Mercer and State aforesaid of the other part. Witnesseth that whereas the said John Prather has Judgment against the said Benjamin Fisher for the sum of $1,000 besides Interest and costs which Debt has been Repleved and the Replevy bonds are now due and the sd Benj Fisher has recovered a Judgement against sd Prather for a breach of his covenant binding him to convey 200 acres of land on Buck Creek for the sum of $1,250 besides costs which last Judgment has been enjoined and the Suit now defending in the Rockcastle Circuit Court and the parties aforesaid have this day agreed to settle all matters in dispute between them on the following terms (to wit) 1st the debt due to Prather by Fisher as aforesaid and the Debt due by Prather to Fisher as aforesaid are hereby settled cancelled and discharged. 2nd the parties in each of the Suits at law to pay their own Costs. 3rd the Suit in Chancery now defending in the Rockcastle Circuit Court is to be determined by a decree by the Complainant Prather so far as respects the Deed mentioned in the record and the proceedings which said Fisher is not to be forced to receive on except the cause not being in compliance with the bond and the parties herein agree that the decree shall be and the same hereby is satisfied except costs and interest each party is to pay his own costs except the costs of a change of venue and equal halfs of which is to be paid by each party herein. 4th Benj. Fisher agrees to pay to John Prather $250 cash & $100 in Kentucky current Bank paper on the first day of July next and $250 cash on or before the first day of July 1824 for the payment aforesaid the sd Fisher is to execute his notes for the payment aforesaid of this date. 5th after the payments herein before mentioned shall have been fully made and completed, then the said John Prather binds & obliges himself to execute a deed of conveyance for the 200 acres of land described in his bond Executed to Smith & Thompson and by them assigned to said Fisher which Deed is to be such as the bond aforesaid may require to satisfy the same. In witness whereof we have hereunto set our hands & seals the day and date aforesaid.

The foregoing was the substance of all the evidence addressed and being gone through, the Deft by his attonrey moved the Court to instruct the Jury, that if they believed that the mill had fallen to Benjamin Fisher by the compromise afsd, that they could not find for the Pltff and the Court sustained the said motion & instructed the Jury accordingly, to which opinion of the Court the Pltff excepts & prays this his Bill of exceptions to be signed sealed & recorded & the same is done accordingly.

William A. Gregory Complt against Edward McDowell Deft } In Chy. This Court now being sufficiently advised rendered a written Decree herein which is ordered to be recorded and the same follows in these words (to wit):
This day came the parties by their counsel and this cause being heard on the Bill and amended Bill of Complt, the ans and cross Bill of Deft McDowell the Depositions and exhibits on file among the papers of this suit, whereupon it seems to the Court that the Complt has manifested his right to the relief sought by his Bill. It is therefore now Decreed & ordered that the contract of sale & Deed of conveyance made between the Deft McDowell and the Complt for the two tracts of land in the original Bill mentioned one of 50 acres and the other of 15 acres be and is hereby set aside and held for naught. It is further Decreed and ordered that an account be taken of the rents and profits of the 15 acre tract and waste if any that has been committed on the same by Complt since his purchase and in what the same consists and also of the payments made by Complt when made & the amt of each of the lasting and valuable improvements made on said tract of land by Complt since his purchase afsd and in what they consists and the costs of this suit including $10 as a comr fee and that Bensone Goggin be and he is hereby appointed an auditor herein to take said account which he is directed to do and make his report of the same and all evidence introduced before him by the parties and the substance of parole evidenced heard by him must be reduced to writing and reptd as afsd and for any balance the said Complt may have in his favour upon the taking of said account he is hereby decreed a lien on the said 15 acre tract said Comr is to make his rept to the next Term of this Court and upon the cross Bill of the Deft McDowell agt Ebenezer Thompson & Wm A. Gregory, it is Decreed and ordered that the said cross Bill be and is hereby Dismissed and that the Complt McDowell in said cross Bill do pay to Defts Thompson & Gregory & Quarles their costs about their Defence therein expended to be taxed by the Clerk for which they may have execution.

William A. Gregory Complt agt Edward McDowell Deft } In Chancery. The Court being sufficiently advised rendered a written Decree herein which is ordered to be recorded and eter [Sic: entered] same follows in these words, to wit:
The Defendant McDowell having failed to pay to the Complt the sum of $59 and the cost of this suit as directed by a former Interlocutory Decree herein and failed to bring said sums of money into Court for the use of the Complt, it is now by the Court Decree and ordered that the Tract of fifteen acres of land in the Bill mentioned or so much of the same as may be necessary to satisfy and pay said several sums of money together with the further sum of $7.50 cts allowed to commissioner for making sale and Deed for the land be sold at public auction at the Courthouse Door in Somerset on some Court day at public auction to the highest bidder on a credit of three months the purchaser serving bond with good security in the penalty of $100 for the purchase money payable to Complt to have the effect of a replevin bond on which Execution may issue said sale to be advertised in the same manner as sales of land under Execution is directed by Law to be advertized. It is further Decreed & ordered that Bourne Goggin be and is hereby appointed this Court Commissioner to make said sale which he is directed to do and report to this Court at the next Term of this Court his actings and doings under this Decree.

This day came the plaintiff by his attorney who produced and filed his declaration herein and notice thereunder written and it appearing from the Sheriffs return thereon that the said declaration and notice have been duly served on Edward McDowell the tenant in possession and the said Edward McDowell failing to appear here and cause himself to be made defendant herein in the room and stead of the now defendant Richard Roe, wherefore on the motion of the plaintiff by his attorney it is ordered that unless the said Edward McDowell the tenant in possession he having legal notice of this order do appear here or some one for him on the first day of the next term of this Court and cause himself or themselves to be made defendant or defendants in the room and stead of the __ defendant Richard Roe __ in declaration in a plea of trespass in ejectment of the tenements in question confess the lease entry and ouster in the declaration supposed pleas the general issue and enter into the common [circle] to insert on the title only at the trial that Judgment shall be had agt the said Richard Roe him the case at ejection by default and the comminer [difficult to read].

Therefore on motion of said Colyer by his attorney, it is considered and ordered by the Court that he recover against said Edward McDowel one hundred & fifty pounds of Tobacco to be computed at the rate of one penny per pound and twenty four dollars fifty six & a half cents in manner & form aforesaid confessed. It appearing to the satisfaction of the Court that Levona McDowell & Julina McDowell was heretofore bound in an Indenture to David Huddliston who has been removed beyond the limits of this state it is ordered by the Court that said Indenture to be recended and for nothing held And it also/alas appearing to the Court said Levona & Julina has been taken out of the [possession] of the sd David Huddeston without his knowledge or consent & conveyed beyond the limit of this state to parts unknown, On motion it is considered by the Court that the said Indenture heretofore entered into be & the same is canceled & for nothing held.
